Terms of Service

1. Acceptance of these Terms

These Terms of Service (the "Terms") form a binding agreement between you and PixelPrism ("PixelPrism", "we", "us", "our") at pixelprism.ai. By creating an account, calling our API, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these Terms.

If you are using PixelPrism on behalf of a company or other legal entity, you represent that you are authorized to bind that entity, and "you" includes that entity.

2. The Service

PixelPrism provides forensic image-analysis services that estimate the likelihood that a digital image was generated or modified by AI. The Service is offered through:

• A web application at pixelprism.ai (signup, dashboard, web upload UI);
• A REST API at https://pixelprism.ai/api/detect with Bearer-token authentication;
• An on-premise deployment option for Enterprise customers.

The Service returns a probabilistic verdict (AI_GENERATED or LIKELY_REAL), an associated confidence score, and per-detector forensic signals. Outputs are statistical estimates, not legal determinations of authenticity.

3. Accounts

You must register an account to use the Service. You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account, including all charges incurred by your API keys.

You must be at least 18 years old (or the age of majority in your jurisdiction). The Service is not directed to children under 13, and we do not knowingly collect personal information from children.

4. Fees & Billing

Subscriptions

Paid plans are billed in advance on a monthly or annual cycle through Stripe. Pricing is published at /pricing.html and is subject to change with notice as described in Section 13.

Overage

Detection requests beyond your plan's monthly quota are billed at the per-image overage rate listed on the pricing page. Overage charges are reported to Stripe via metered usage and added to your next invoice.

Refunds

Subscription fees are non-refundable except where required by law. If we terminate your account for cause, no refund of remaining subscription time will be issued.

Failed payments

If a charge fails, we may suspend the Service until payment is received. Repeated payment failures may result in account termination.

5. Acceptable Use

You agree not to use the Service to:

• Submit images you do not have legal right to process — including non-public-domain images you do not own or have license to use;
• Process imagery depicting child sexual abuse material (CSAM), non-consensual intimate imagery, or content that violates applicable law;
• Reverse-engineer, scrape, or attempt to derive the underlying detection models, training data, or weights;
• Use the Service to develop a competing AI-detection product, classifier, or dataset;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its infrastructure, or other customers' accounts;
• Resell, sublicense, or share API keys without an Enterprise agreement that explicitly permits doing so;
• Use the Service in any application where a misclassification could result in physical harm without independent human review (e.g., autonomous decisions affecting personal liberty, employment, or insurance).

We may suspend accounts that violate this section without prior notice.

6. Your Content

You retain all rights to the images you submit ("Customer Content"). You grant PixelPrism a limited, non-exclusive, worldwide license to process Customer Content solely to provide the Service to you.

We do not retain Customer Content after detection completes. Image bytes are held in memory only for the duration of the request; only metadata about the request (file size, verdict, confidence, timestamp) is stored in our usage records.

Customer Content is never used to train PixelPrism's detectors or any other model.

7. API Use

API access is governed by your plan's monthly image quota and per-tier rate limits. We may impose additional rate limits to protect Service stability or prevent abuse.

API keys are sensitive credentials. You agree to:

• Keep keys confidential — do not commit them to public repositories or expose them in client-side code;
• Rotate keys promptly if compromised, via your dashboard at /dashboard;
• Notify support@pixelprism.ai of any unauthorized use of your account.

You are responsible for all charges arising from use of your API keys, including by third parties to whom you grant access.

8. Availability

We make commercially reasonable efforts to keep the Service available but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages (Stripe, payment processors, cloud providers), and force majeure events may cause downtime.

No SLA is offered on the Free, Starter, or Pro tiers. Enterprise customers may negotiate written SLAs in their service agreement.

9. Termination

You may cancel your account at any time from the dashboard or by emailing support@pixelprism.ai. Cancellation stops future billing; access continues through the end of the paid period.

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or use the Service in a manner that harms PixelPrism, our infrastructure, or other customers. Upon termination we may delete your account data after a 30-day retention window for billing reconciliation.

10. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DETECTION RESULTS. AI-DETECTION TECHNOLOGY IS PROBABILISTIC AND IMPERFECT; YOU AGREE NOT TO RELY ON DEEPSCAN'S OUTPUTS AS THE SOLE BASIS FOR LEGAL, EMPLOYMENT, OR REGULATORY DECISIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEEPSCAN'S TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DEEPSCAN IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

IN NO EVENT SHALL DEEPSCAN BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to defend, indemnify, and hold PixelPrism harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Service in breach of these Terms, (b) Customer Content you submit, or (c) your violation of any third-party rights or applicable law.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email to your registered address at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction therein.
